Judge Cadsby criticizes police actionLifesite - Linda Gibbons page, Oct. 22, 1998Judge Milton cadsby made the following comments during the show cause hearing of Linda Gibbons and Anneliese Steden on October 5, 1998 in the Ontario Court of Justice (Provincial Division) in Toronto. "Any evidence that I heard indicates to me that this was peaceful picketing which, except for the injunction would be lawful." "The defendants may have an arguable, legal defence to the charges. The police in this case arrested them for causing a disturbance. I heard no evidence of a disturbance. If there was any disturbance, it sounded as (if) it was caused by the police." "I will repeat once again, it is not up to the police officers to enforce this civil injunction order." "What they seem to have done is reverse section 141 of the Criminal Code, the sheriff is the only one who can enforce the order..." "What the Crown asked for by way of a condition, seems to this court to be a greater restriction on the liberty of these defendants than the injunction itself; it is broader than the injunction." |
