Nova Scotia Latest to Capitulate on Homosexual 'Marriage'
HALIFAX, September 24, 2004 (LifeSiteNews.com) - Nova Scotia Supreme Court Justice Heather Robertson has ruled traditional marriage between one man and one woman unconstitutional redefining it to "the lawful union of two persons, to the exclusion of all others." Nova Scotia marks the sixth Canadian region to redefine 'marriage' through judicial fiat. The five other regions are: Quebec, Ontario, Manitoba, British Columbia and the Yukon.
The case was brought by three homosexual activist couples Ross Boutilier and Brian Mombourquette, Ron and Bryan Garnett-Doucette, and Kim Vance and Sam Meehan, and argued by their lawyer Sean Foreman.
Neither the federal government nor the provincial government attempted a defence of traditional marriage. Nova Scotia Premier John Hamm announced yesterday the province would not stand up for marriage saying, "We will follow what the law of the land is."
Hamm's statement is reminiscent of the 1850's thinking of Stephen Douglas who argued with Abraham Lincoln over slavery. Referring to the U.S. Supreme Court decision to back slavery in the Dred Scott case Douglas said:
"Unless we respect and bow in deference to the final decisions of the highest judicial tribunal in our country, we are driven at once to anarchy, to violence, to mob law, and there is no security left for our property, or our own civil rights."
"It is no argument to say that slavery is an evil, and hence should not be tolerated. You must allow the people to decide for themselves whether it is a good or an evil." "...the right of every person to judge for himself whether a thing is right or wrong, whether it would be good or evil for him to do it; and the right of free action, the right of free thought, the right of free judgment upon the question is dearer to every true American than any other under a free government."
