Kansas Department of Health Refuses Documents Key to Case Against Planned Parenthood

PP attorney wonders how Kline can prosecute without evidence

TOPEKA, KA, April 1, 2008 (LifeSiteNews.com) - The Kansas Department of Health and Environment have refused to hand over the legal documents that Johnson County District Attorney Phillip Kline contends are key in convicting Planned Parenthood of Kansas and Mid-Missouri and Comprehensive Health of 23 felonies and 84 misdemeanors. 

In October 2007, Kline filed a criminal complaint against PPKM and CM in which he accused PPKM and CM of manufacturing or forging documents related to 23 late-term abortions. 

A hearing is scheduled Wednesday that could reject Kline's subpoena for the 23 documents.
 
PPKM is confident that Kline's complaint will fail if District Court Judge Stephen Tatum agrees to the KDHE motion to squash the subpoena.

"If he [Kline] doesn't have the evidence, how can he prosecute?" stated Planned Parenthood attorney Pedro Irigonegaray.
 
According to current state law, only the attorney general or the Board of Healing Arts can gain access to information on abortion patients, provided it is for the purpose of criminal or disciplinary proceedings. 

Representative Lance Kinzer, however, has already introduced legislation that would also give the district attorney access to abortion patient information.

In June 2006, former Kansas Attorney General Paul Morrison did not report any criminal wrongdoing during his investigation into the records Kline now requests.

In January, however, Shawnee County District Judge Richard Anderson questioned Morrison's examination, noting that PP records did not match information in the health department's records.

Morrison resigned in December after allegations of sexual harassment and interference with state investigations into late-term abortionist George Tiller.
