Aurora Zoning Board Stands By Planned Parenthood Mega-Abortion Center despite the Law and Lies

AURORA, Illinois, January 10, 2008 (LifeSiteNews.com) - Zoning officials in the city of Aurora have decided to permit Planned Parenthood's new mega-clinic to open, despite the fact that the facility was constructed under the wrong zoning ordinance and the public was deceived deliberately regarding its true purpose.

WorldNetDaily reports, however, that pro-life opponents are refusing to let city officials passively accept the establishment of the new Planned Parenthood abortion center - reputedly the largest in the United States - as a fait accompli. They are denouncing the fact that the abortion provider deceived the city and the public by using a front company, Gemini Office Development (GOD), to construct surreptitiously the 22,000-square-foot clinic. Suspicions were raised after a pro-life construction worker reasoned that the bullet-proof glass and surgical equipment that were being installed were not standard fare for an ordinary office building.

"The next steps in this case will be taken," Eric Scheidler of Families against Planned Parenthood told WND. "This case is far from over."

The Thomas More Society is assisting Eric Scheidler's group in handling the case. They have informed officials on Aurora's zoning board of appeals that the land is zoned for a for-profit corporation, while Planned Parenthood has non-profit status, through which it obtained more than $8 million in state bonds to build the abortion center.

Nevertheless, board members voted this week to dismiss the case on the basis that the appeal did not fall within their jurisdiction.

Peter Breen, a TMS lawyer working on the case, told WND that the appeal's dismissal now opens up the possibility of a lawsuit over the morass of issues involved with the clinic. 

According to Breen, the city revealed it had committed a major error in the project, when they began referring to ordinance 093-124 rather than to 093-123, "which had expired and which they had been citing previously," to justify the case.

"In addition, the city cited the wrong ordinance as a basis for favorable zoning determinations in a pair of investigations undertaken by two touted zoning experts, private lawyers acting on behalf of the city, which led to Mayor Tom Weisner announcing the renewal of Planned Parenthood's temporary occupancy permit" said the Thomas More Society in a statement.

"If the proper ordinance had been cited and complied with, Planned Parenthood should never have opened."

The city's attorneys have said that zoning challenges must be made within a 45-day appeal period. The zoning decision for the development by Gemini Office Development (GOD) was in 2006. However, Scheidler and other pro-life advocates maintain that the public had no way of knowing what was being established in their city in that period, because of the deceptions by Planned Parenthood and the lack of oversight by the city. Scheidler said pro-life opponents of the clinic will decide soon either to pursue more appeals with the city board or take the case to court.
