Unsealed Court Records Show Attorney General Actively Undermined Planned Parenthood Prosecution
OLATHE, Kansas, May 14, 2008 (LifeSiteNews.com) - Operation Rescue has obtained court records, which were unsealed last week, that show Attorney General Stephen Six actively undermined District Attorney Phill Kline's prosecution of 107 criminal charges against Planned Parenthood.
On the morning of April 3, Kline issued a subpoena to Judge Richard Anderson, ordering him to testify at a preliminary hearing on April 7 in the Planned Parenthood criminal case, and to produce fifteen documents from Kline's inquisition that was conducted while he was the state attorney general. The subpoenaed documents included a series of letters and other papers regarding KDH&E records that had, according to Judge Anderson, been improperly altered or manufactured.
None of the documents subpoenaed had information that could be considered private medical information.
Later that day, Judge Anderson filed with the Kansas Supreme Court, informing them of the subpoena and his intention to comply with it.
Five minutes later, according to time stamps on the records, Attorney General Stephen Six filed a motion asking for a protective order on all information related to Kline's inquisition, and asking that the High Court quash Kline's subpoena to Anderson.
The following day, the Court ordered Anderson not to appear as commanded by Kline's subpoena, and ordering him to maintain exclusive possession of the inquisition records.
This is the second incident of critical evidence being denied to Planned Parenthood's prosecutors. On April 28, Judge Stephen Tatum ruled that the KDH&E did not have to honor another subpoena from Kline.
"These outrageous orders show unprecedented obstruction of a criminal prosecution through the intentional withholding of evidence," said Operation Rescue President Troy Newman. "One has to ask why this prosecution is being stonewalled and sabotaged by the Attorney General's office and the KDH&E. The answer might be found in the fact that both the A.G. and the KDH&E members were appointed by Gov. Kathleen Sebelius, who was elected with the help of a massive infusion of abortion money.
"More and more, evidence points to a conspiracy inside the government to obstruct abortion-related prosecutions. Operation Rescue promises to pursue every legal avenue until the corruption protecting Planned Parenthood is exposed and rooted out so true justice can be done."
