Woman must Repay Government costs of Eugenic Abortion, US Court Rules
SAN FRANCISCO, August 19, 2005 (LifeSiteNews.com) - A federal appeals court ruled Thursday that the wife of a US navy man must pay the government back the US $3000.00 it spent aborting her child because the military refuses to fund eugenic abortion. Under federal law, the US military only pays for abortion in cases where the mother's life would be endangered by childbirth.
The Ninth U.S. Circuit Court of Appeals in San Francisco ruled that the woman's constitutional right to abortion was not violated in the case since under federal law, the military only pays for abortion if the mother's life would be endangered by childbirth.
"The foregoing discussion may seem at times callous and unfeeling," Judge Richard Tallman said. "We express our deepest sympathy for the families who must face this difficult ordeal."
The woman, identified in court documents only as "Jane Doe" sought an abortion when her child was diagnosed with anencephaly.
The court said that the government has a legitimate interest in "protecting potential life" and that this is true even when the fetus has no chance for survival.
