We hope you are adjusting to the changes to the website. It is still undergoing a fair amount of adjusting. Whenever a major update is launched glitches always need to be corrected and this time has been no exception. Some of you may have noticed, for instance, that "Send to a Friend" was not working at first. That has been repaired.

Today I had a very pleasant visit from a Brazilian student who is an avid LifeSiteNews reader. He related how well LifeSiteNews is known to the Brazilian pro-life community. He was assigned to interview us and take some photos for a report to be posted on a Brazilian pro-life blog. This young man, who seemed to be very competent and upbeat, was to me a sign of a vibrant, growing Brazilian pro-life movement that will likely become a wonderful example to the world.

Radical Kosovo Constitution Removes all Protection for the Unborn and Traditional Family
Cedes interpretation of social norms to UN international human rights bodies

NEW YORK, February 20, 2008 (C-FAM.org) - On Sunday, the province of Kosovo declared independence from Serbia and now has four months to adopt a new constitution. The draft constitution, which is circulating now, would transform the traditional Muslim and Orthodox Christian society by removing all legal protection from unborn children and granting special rights on the basis of sexual orientation. Additionally, the draft document cedes the interpretation of social norms to international human rights bodies centered at the United Nations.
Article 25 of the draft document on the "Right to Life" removes protection from the unborn stating that, "every individual enjoys the right to life from birth," and Article 26 grants "the right to make decisions in relation to reproduction in accordance with the rules and procedures set forth by law," further giving each Kosovar "the right to have control over his/her body in accordance with law."
The draft constitution specifically ensures that "no one shall be discriminated against on the basis of … sexual orientation" but gives no special protection to the traditional family. In fact, the English version of the draft article on the "Right to Marriage and Family" leaves out mention of men and women, stating only that "Based on free will, everyone enjoys the right to marry and the right to have a family."
"Direct applicability" of eight international treaties would be imposed once Kosovo adopts the constitution, including the Convention on the Elimination of Discrimination Against Women (CEDAW), the Convention on the Rights of the Child, and the International Covenant on Civil and Political Rights and its Protocols.
The committees appointed to monitor each of these treaties have come under fire recently for misinterpreting the documents to include abortion and other controversial ideas specifically left out of the documents by the nations that negotiated them. Nonetheless, the draft constitution states that interpretation of the rights contained in the documents will rely on "the case law of the European Court of Human Rights and other international bodies that oversee the implementation of internationally guaranteed human rights."
The draft constitution was initially authored in 2004 by a non-governmental organization (NGO) called the Public International Law and Policy Group (PILPG). One of its authors, Professor Bruce Hitchner of Tufts University told the Friday Fax that the constitution has essentially maintained its original form and that after the NGO drafted it they passed it to the Venice Commission, an advisory body of the Council of Europe. According to Hitchner, European lawyers evaluated and assessed the document and Americans also worked on it "quietly."
The Venice Commission, established in 1990 to assist former communist countries' transition to democracy, gave it to the Constitutional Commission of Kosovo. The chairman of that commission, Professor Hajredin Kuci, stated this week that "commission members will visit municipalities and organize meetings" inside Kosovo for public comment on the document before it reaches the 120-day deadline for adoption mandated by UN Secretary General Ban Ki-moon on March 26, 2007.
Both the United States and the Holy See are members of the Venice Commission though it is unclear if either government was aware of the radical nature of the new Kosovo constitution.
Peruvian Bishop Condemns Illegally Created Abortion Protocol

LIMA, February 21, 2008 (LifeSiteNews.com) - The Catholic Archbishop of Arequipa, Javier del Rio Alba, is denouncing a recent decision to create a "protocol" allowing abortions for virtually any reason in regional hospitals. Bishop Alba says the protocol is illegal and unconstitutional, according to the Catholic news service ACI Prensa.
According to the Archbishop, who is vice-president of the Peruvian Episcopal Conference, the protocol will convert Arequipa into the "death capital" of the area and said that those who had collaborated in creating the protocol "should only be compared to Satan."
"The Regional Health Management has approved a fallacious and dishonest protocol. Arequipa will not allow innocent children to be killed," said the archbishop in a recent homily. "Arequipa is traditionally Catholic and has now become the death capital for innocent children. Are we going to permit that? Are we going to applaud that?"
As LifeSiteNews reported last year, a large number of organizations funded by wealthy American foundations have been orchestrating a campaign to legalize abortion in Peru through the "back door", using a "therapeutic abortion" protocol for hospitals (see previous coverage at http://www.lifesitenews.com/ldn/2007/jul/07071605.html).
Although abortion is illegal in Peru and violates the nation's constitution, the national criminal code provides no penalties for abortions done ostensibly to protect a woman from a "serious" illness. An abortion protocol gives a specific list of medical conditions and circumstances that are regarded as falling under the penal code's exemptions.
Two protocols have already been created for San Bartolomé and Belén de Trujillo hospitals in Peru, and the Peru Medical College and Peru College of Obstetricians have endorsed the protocol idea, with the backing of the Planned Parenthood Federation of America, the International Planned Parenthood Federation, and Ipas, which are all based in the U.S.
The new protocol, which was approved by the Regional Health Management of Arequipa, in the south of the country, is to be used by doctors to justify abortions to protect a woman's "health." The protocol reportedly lists 24 different medical conditions for which it regards "therapeutic" abortion as a justifiable response.
Archbishop Javier de Rio Alba's denunciation was supported by Peruvian congressman Juan Carlos Eguren, who stated that the Peruvian Constitution "indicates that the defense of the human person and respect for his dignity are the supreme purpose of society and government," according to ACI Prensa.
However, a feminist radio station in Lima, Milenia Radio, issued a statement rejoicing over the news, noting the "great expectation and satisfaction among women's movements".

Abortionist Who Killed 22-year-old Barred from U.S. Medical Practice

HYANNIS, Massachusetts, February 21, 2008 (LifeSiteNews.com) - An abortionist responsible for the death of a 22-year-old woman permanently resigned his medical license in the United States on Wednesday.
Dr. Rapin Osathanondh, a gynecologist from Massachusetts, relinquished his medical license in an effort to avoid an investigation by the Massachusetts Board of Registration in Medicine. Osathanondh was responsible for the death of Laura Hope Smith, a 22-year-old woman who went to Osathanondh's clinic for an abortion on September 13, 2007.
Although early reports indicated that Laura Hope Smith died of hemorrhage from the abortion, her mother, Eileen Smith, contended otherwise.
"There was no bleeding," said Smith in an interview in September. "She stopped breathing and went into cardiac arrest."
The Massachusetts Board of Registration in Medicine confirmed Eileen Smith's claims, declaring the death due to "cardiac pulmonary arrest during anesthesia during a voluntary termination of pregnancy."
Osathanondh, according to reports, administered anesthesia without aid and while alone. Laura Hope Smith died later that day, with Osathanondh marking her death up to hemorrhage. Eileen Smith never knew her daughter was pregnant until she received a phone call telling her that her daughter and grandchild were both dead.
"To say my world was rocked to its core is an understatement," she said.
The Massachusetts Board of Registration in Medicine had already moved to revoke Osathanondh's medical license, calling him a "risk to public safety." In consequence of giving up his medical license, Osathanondh will never be permitted to practice medicine in any of the 50 states again. He still faces disciplinary action and a possible grand jury indictment.
Eileen has asked for prayers, and is glad that her efforts in the last five months have been fruitful. She never believed her daughter would have an abortion, and thought she was doing enough to combat it in raising her family in the Christian tradition.
"I believed if I lived my Christian life, preached the gospel, raised my children with Christian principles, that not only would abortion not touch my home, but we could make converts to Christianity and thereby lower the numbers," she said. "I was wrong on all counts."
Eileen Smith has vowed to spend the rest of her life battling abortion in memory of her daughter. She says that God "is the head of the pro-life movement and He will guide and direct and empower us if we but hear His voice and follow His heart."

Judge Revises "Insufficent and Unfair" Wording of Anti-Cloning Ballot Proposal

JEFFERSON CITY, Missouri, February 21, 2008 (LifeSiteNews.com) - A Missouri judge has ruled in favor of a challenge, filed by the pro-life group Cures without Cloning, against language that was adopted by the Missouri Secretary of State for the ballot title of an anti-cloning amendment. The group claimed that the Secretary of State's language for the amendment title, which they are attempting to have placed on the November 2008 ballot, was unfair and biased against the anti-cloning proposal.
Judge Patricia Joyce agreed with the group, and ruled that the ballot title, which was penned by the office of Secretary of State Robin Carnahan, was "insufficient and unfair." The judge instructed the court to pen a new form of the amendment title.
While Judge Joyce did not specifically elaborate on how the wording was found deficient, she did invoke previous Missouri rulings which have stated: "Insufficient means 'inadequate; especially lacking adequate power, capacity or competence.' The word 'unfair' means to be 'marked by injustice, partiality, or deception.' Thus, the words insufficient and unfair . . . mean to inadequately and with bias prejudice, deception and/or favoritism state the consequences of the initiative."
Carnahan's office, however, claims that its description of the amendment was fair and accurate.
The original ballot title, as certified by the Secretary of State, was much vaguer than Cures without Cloning's proposed language, and cast the amendment in more negative terms. The title asked voters whether they would like to amend the Missouri Constitute to "limit Missouri patient's access to stem cell research, therapies and cures" by "redefining the ban on human cloning or attempted cloning to criminalize and impose civil penalties," and "prohibiting hospitals or other institutions from using public funds to conduct such research."
The new title, however, is more specific about the particular type of research that will be banned. It asks if the Constitution should "be amended to change the definition of cloning and ban some of the research," by "prohibiting human cloning that is conducted by creating a human embryo at any stage from the one-cell stage forward."
The title also specifically puts the amendment into more positive terms by explicitly making the often-fudged distinction between embryonic and adult stem cell research. The amendment, the title says, shall allow "stem cell research for therapies and cures that complies with these prohibitions." It also states that the amendment would "prohibit expenditure of taxpayer dollars on research or experimentation on human cloning."
Now that its legal challenge is resolved, a spokesman for Cures without Cloning said supporters plan to start gathering the petition signatures needed to qualify for the November ballot.

Australian State and Territorial Governments to Introduce Euthanasia Bills this Year

CANBERRA, February 21, 2008 (LifeSiteNews.com) - Two jurisdictions in Australia are bringing forward legislation that would reinstate "medically-assisted voluntary euthanasia" in the island nation.
Senator Robert Brown, leader of the Green party, is introducing a private members' bill in the Federal Parliament that would reinstate the Rights of the Terminally Ill Act in the Northern Territory. The Rights of the Terminally Ill Act, which permitted euthanasia, was initially passed in the Northern Territory in 1995, but was later overruled by a 1996 law.
At the same time, in the state of Victoria, Liberal MP Ken Smith has agreed to introduce a Bill to allow physician-assisted suicide. Green MP Colleen Hartland has announced she will co-sponsor the Medical Treatment (Physician Assisted Dying) Act 2008, some time in the next six months.
Smith said the bill would decriminalize the act of assisting or supporting suicide. "I feel very strongly about this," he said. "I've seen a lot of people die, a lot of people in agony, and a lot of people who shouldn't have to put up with pain but they did. I just think that something like this would be a worthwhile contribution to my time in Parliament."
With the defeat of John Howard's Liberal party in Australia late last year, some are anticipating an end to the protections for human life that had been an earmark of the previous government. Other issues facing MP's in the next year give credence to these fears about an impending turn-around in Australia's social establishment. Efforts at decriminalizing abortion, providing artificial procreation treatments such as IVF to single and lesbian women, and setting up a register for same-sex couples are amongst the list of issues coming up for vote.
Right to Life Association's Margaret Tighe called the euthanasia proposal "the most dangerous public policy for any government to be embracing, or to allow it to be embraced". Tighe said the law simply "leads to legalised patient killing".
Speaking to Barney Porter on ABC Local Radio, Tighe said such legislation is only the beginning and that in countries where euthanasia is legal, it eventually expands. "One of the main reasons why euthanasia has not been legalised in very many places is because it is a very dangerous public policy, and because it can lead to some people losing their lives who shouldn't be losing their lives. It's the very same reason why people oppose capital punishment."
The Labour Party, led by the Prime Minister Kevin Rudd, took power in Australia in December 2007, and the party is now in power in every parliament in the country. Rudd has pledged not to intervene in state or territory legislation. In the short time the new government has been in power, life and family advocates have been given cause for concern.
This month, the Gay Pride Parade in Melbourne was warmly endorsed by Rudd who said the demonstration, known around the world for public displays of nudity and simulated sex acts, would "continue to march towards tolerance, respect and diversity". In endorsing the event, Rudd became the first-ever Australian prime minister to support an explicitly pro-homosexual event.
Bill Banning Discussion on Homosexuality in Tennessee Schools Fails

NASHVILLE, February 21, 2008 (LifeSiteNews.com) - A bill meant to stop discussion of homosexuality in elementary and middle school classrooms in Tennessee has failed, but its sponsor insists it is necessary. State Representative Stacey Campfield, a Republican of Knoxville Tennessee, said that efforts around the country to bring such instruction into schools now require attention in Tennessee.
The House Education K-12 Subcommittee voted to allow the state Board of Education to examine the bill, a move that Campfield said effectively killed it.
After the bill was defeated, Campfield continued to insist it is a necessary measure. Schools, he said, should not be "pushing a position one way or the other" on sexuality. "A lot of places are starting to push these topics on to children and talk about these lifestyles and advocate a position one way or the other on these lifestyles," he said.
Campfield stood in support of the right of parents, not schools, to be in charge of what children learn about sexuality. "We're saying we're going to leave it alone. We're going to let the families decide when it's appropriate and when to talk about it and how to talk about it," he said. "It's not the position of our schools to be advocating a lifestyle."
The bill said the issue of human sexuality is "enormously complex" and said "no public elementary or middle school shall provide any instruction or materials discussing sexual orientation other than heterosexuality."
Legislators argued that the bill was unnecessary since homosexuality is not an official part of the curriculum in the state. Bruce Opie, legislative liaison for the Department of Education, claimed that no instruction provided in Tennessee middle schools or elementary schools on homosexuality, though he admitted it is possible the topic could come up in classroom discussion.
But Campfield said he put the bill forward in response to two complaints from parents that the subject was being included in some schools.
"A lot of people have very strong (religious) beliefs," Rep. Campfield said, noting he was concerned schools might promote "acceptance" of homosexuality rather than "tolerance."
But Opie told the committee that "as far as sexuality is concerned, most of the information that is provided is at middle-school grades and high school, and it is in the context of abstinence."

US, February 21, 2008 (LifeSiteNews.com) - At the same time that news has come out that the Toronto Catholic School board has refused to participate in pro-homosexual activities, homosexual activists are making significant inroads in US schools, as a booklet titled, "Just the Facts about Sexual Orientation and Youth," is set to be distributed to all 16,000 school districts in the country.
The 24-page booklet by the National Education Association and American Psychological Association, tells students that homosexuality is a "normal expression of human sexuality".
"What's so scary and dogmatic about this report is that it communicates that religious-based viewpoints are harmful, and even dangerous," said Candi Cushman, education analyst for Focus on the Family Action.
The booklet particularly targets the idea that homosexuality is a condition that can be changed. It instructs educators, "Schools should be careful to avoid discussions of transformational ministry in their curriculum."
Brian Raum, senior legal counsel for the Alliance Defense Fund, said that the talk of "inclusivity" in schools by homosexual groups is a veiled threat.
"What they're trying to do is create a fear factor here," he said. "There's nothing in the Constitution that would prohibit a teacher from presenting to a student all of the programs that are available, without endorsing or promoting any particular one."
The National Association for Research and Therapy of Homosexuality, (NARTH) says that although "the aim of gay-affirmative counselling programs is humanitarian", the problem is that they do "much more" than discouraging scapegoating.
"In reality, they promote a particular worldview," present students with a set of "truth-claims that students are expected to adopt," and insist on conformity to these.
"These programs promote the value systems of a particular social group and denigrate the views of another, while at the same time, distorting science."
Catholic School Board Refuses to Conduct Survey Meant to Detect "Homophobia"

TORONTO, February 21, 2008 (LifeSiteNews.com) - The Toronto District Catholic School Board has declined to participate in a school survey to probe students' opinions on homosexuality. Sponsored by Canada's leading homosexual political lobby group, EGALE Canada, the online survey, titled the "First National Climate Survey on Homophobia in Canadian Schools", is intended to detect "homophobia" in schools.
After the passage of Canada's same-sex "marriage" legislation, EGALE vowed to begin its campaign to bring homosexual information into Canada's schools. The group says that "schools must not only have proactive and comprehensive discrimination and harassment policies, they must also ensure the presence of an inclusive curriculum."
In total, only three Catholic boards in Canada, Toronto and Guelph in Ontario, and one other in Alberta, have declined, although it is unclear if the others have agreed to participate. After a review of the survey, the Toronto board concluded that it "is not appropriate or helpful in nurturing our Catholic community."
But merely to decline to participate in such activities is taken by gay activists as de facto proof of "homophobia". EGALE executive director Helen Kennedy responded to the decision, describing homophobia as "prevalent in the Catholic system as it is in the public system."
She said, "The study is not about sexual behaviour, it is about social behaviour. It's about bullying, harassment and taunting in our schools."
The survey asks students, "If you have one or more LGBTQ family members and you are NOT 'out' about your family status at school, please explain why." Students are asked to judge the friendliness of their school to homosexuality by outlining whether the school includes, "LGBTQ History (i.e. Stonewall Riots, Homosexuals during the Holocaust)", "LGBTQ Literature that had LGBTQ characters or themes" in the curriculum, or events such as "Pride Days" and the "National Day Against Homophobia".
Students are asked, "How many teachers or other staff members in your school are openly lesbian, gay, bisexual or transgender?"
A Toronto Catholic School Board staff report said that Ontario Minister of Education Kathleen Wynne, herself a lesbian and gay activist, had requested that school boards permit students to participate.
Homosexual Pair Attempts "Matrimony" in Argentina
Event staged as test case to force legalization through the courts

ROSARIO, Argentina, February 21, 2008 (LifeSiteNews.com) - A pair of homosexuals were rebuffed Monday by a judge in Rosario, Argentina, after requesting permission to "marry" each other under Argentine law.
The two men, Martín Peretti Scioli and Oscar Marvich, were accompanied by a number of Argentine politicians and celebrities, as well as a notary, who formally registered the judge's decision.
"We are coming to formally request a date to marry each other just like any heterosexual couple, because we consider ourselves to be citizens with rights, and we want a civil union," said Peretti to the judge, who denied their request based on provincial law.
The intention of the pair is to create a test case that they hope will lead to a decision legalizing gay "marriage" in Argentina. They are reportedly prepared to appeal the case to the nation's Supreme Court.
Their petition for "marriage" is backed by the Argentine Federation of Lesbians, Gays, Bisexuals, and Transsexuals (FALGBT) as well as the National Institute Against Discrimination, Xenophobia, and Racism (INADI). The latter organization says that they will give legal assistance to the pair for the litigation of the case in the Argentine courts.
FALGBT says that they will promote the case with the slogan "the same rights with the same names", indicating their desire to avoid the term "civil union" in favor of "marriage" for homosexual couples.
Among those who accompanied the couple to the event were Silvia Augsburger, president of the socialist bloc in the Argentine Chamber of Deputies, Miguel Zamarini, President of the Rosario City Council, and various national and state legislators.
"We're doing this to install the topic in society, to construct valid concepts and destroy myths regarding homosexuality and, also, to encourage other homosexual pairs to demand the rights that correspond to them, to us, and to everyone equally," the couple told AGMagazine, a homosexual publication.
