The Coming "War" Between the Obama Administration and the Catholic Church
By John-Henry Westen
WASHINGTON, November 19, 2008 (LifeSiteNews.com) - The possible signing of the Freedom of Choice Act (FOCA) by President-Elect Barack Obama would be "the equivalent of a war" an unnamed senior Vatican official recently told TIME magazine.
The startling comments make the second time this week that a Vatican official has forthrightly and in the strongest language condemned Obama's extreme policies on abortion. Speaking at the Catholic University of America a few days ago, Vatican Cardinal James Stafford labeled Obama's anti-life policies as "aggressive, disruptive, and apocalyptic," also noting that, "On November 4, 2008, America suffered a cultural earthquake" (see coverage: http://www.lifesitenews.com/ldn/2008/nov/08111703.html ).
With Catholic, but outspokenly pro-abortion individuals occupying two prominent positions (Joseph Biden as vice president and Tom Daschle as Health and Human Services Secretary) the specter of public excommunication or denial of communion for prominent members of the Obama Administration has arisen.
The focus of the Vatican’s concern, FOCA, is a bill that would do away with state laws on abortion, including laws mandating parental involvement, or banning partial birth abortion. FOCA would also compel taxpayer funding of abortions, and, of greatest concern to Bishops, would force faith-based hospitals and healthcare facilities to perform abortions.
Obama has in the past said that he would make signing FOCA one of the highest priorities of his presidency.
Last week at the meeting of US Bishops in Baltimore, Cybercast News Service asked Chicago Cardinal Francis George, the current president of the U.S. Conference of Catholic Bishops, if voting for FOCA would bring a penalty of automatic excommunication for Catholic politicians. The Cardinal did not rule it out.
"The excommunication is automatic if that act is in fact formal cooperation, and that is precisely what would have to be discussed once you would see the terms of the act itself," responded Cardinal George. When asked for more, he added: "The categories in moral theology about cooperating in evil, which make you complicit in the evil even though you don't do it yourself, are material cooperation, which is usually remote and therefore doesn't involve you in the moral action except in a very auxiliary and minor way, and formal cooperation, which would involve you even though you are not doing it, in the way that makes you culpable.
"So we would have to take a look at each case, and at each law, to determine whether or not the cooperation is material or formal. We've never done that."
Cardinal George has, however, personally analyzed FOCA and expressed his grave concerns about the legislation. In a message to the Obama Administration at the end of the USCCB meeting George wrote on FOCA, saying it would, "outlaw any ‘interference’ in providing abortion at will. It would deprive the American people in all fifty states of the freedom they now have to enact modest restraints and regulations on the abortion industry. FOCA would coerce all Americans into subsidizing and promoting abortion with their tax dollars. It would counteract any and all sincere efforts by government and others of good will to reduce the number of abortions in our country."
The Cardinal added: "FOCA would have an equally destructive effect on the freedom of conscience of doctors, nurses and health care workers whose personal convictions do not permit them to cooperate in the private killing of unborn children. It would threaten Catholic health care institutions and Catholic Charities." (see coverage: http://www.lifesitenews.com/ldn/2008/nov/08111209.html )
In light of this possible attempt to revoke conscience rights under the Obama administration, Catholic League president Bill Donohue has urged President Bush to enact regulations, already in draft for months, which would protect the rights of doctors, nurses and health workers from being discriminated against if they refuse to perform or assist in abortions, as well as other morally contentious procedures. "At stake are the religious rights of these professionals," said Donohue.
"To put it differently, were FOCA to become law (it needs to be reintroduced in the House), the culture war that the Vatican official was referring to would come to a boiling point," he warned. "In practical terms, this would mean the closure of every Catholic hospital in the nation: No bishop is going to stand by and allow the federal government to dictate what medical procedures must be performed in Catholic hospitals. Make no mistake about it, the bishops would shut down Catholic hospitals before acquiescing in the intentional killing of an innocent child. Were this to happen, it would not only cripple the poor, it would cripple the Obama administration."
Donohue concluded: "It is for reasons like these that the Catholic League urges President Bush to move with dispatch in instituting rules protecting the religious rights of all health care workers. If Obama wants to undo them, it will set up a confrontation he will surely regret."

University of Calgary Once Again Attempting to Censor Campus Pro-Life Club
"driving onto campus is like crossing the border from a democratic country where we have free speech to a dictatorship which suppresses speech."
By Thaddeus M. Baklinski
CALGARY, Alberta, November 19, 2008 (LifeSiteNews.com) - The U of C is again attempting to censor student members of the campus pro-life club by threatening them with arrest and sanctions for non-academic misconduct (including the possibility of suspension and expulsion) if they do not comply with an order to turn Genocide Awareness Project (GAP) displays inward. GAP is a graphic exhibit which includes photographs of unborn babies who have been aborted.
U of C lawyer Paul Beke addressed a letter to pro-life club members which said, "The university has the right to control what people do on its private property," and stated that the university wants the display set up so "passersby could avoid the displays if they were to wish."
University officials have also told the Calgary Police that the GAP display poses a threat of violence.
An editorial in the Calgary Herald yesterday, however, said that "the only violence here is that being done to the principles of free speech." (See "No good reason to squelch this debate" http://www.canada.com/calgaryherald/news/theeditorialpage/story.html?id=63488636-0de7-4dfd-a231-4c4fb8472329)
Stephanie Gray of the Canadian Centre for Bio-Ethical Reform, commenting on the university's attempt to censor the pro-life club said, "There is an important principle of free expression on campus at stake here. Universities should not be allowed to censor controversial, unpopular or minority viewpoints. If the University of Calgary can censor GAP (on the basis of anonymous complaints from people claiming to be offended), this will have direct implications and consequences for all persons on university campuses throughout Canada (not to mention the state of free expression off-campus)."
"Can you imagine them making this demand (turning the displays inwards) of animal rights activists or those who protest the genocide in Darfur?" Gray asked.
The U of C has in the past shown a lack of consistency in its response to previous GAP displays by the Campus Pro-Life (CPL) club.
Earlier this year the university threatened to enforce a "notice to vacate" the premises if the GAP displays were not turned inward. Instead of following through with that ultimatum, however, the university instead chose to erect a sign which said, "WARNING Campus Pro-Life has erected a display on University grounds without the permission or endorsement of the University of Calgary ... Students, faculty and staff are cautioned that the images are extremely graphic."
Members of the pro-life club, however, pointed out that this unwittingly emphasized the GAP message that abortion, when confronted for what it is, is a deeply disturbing reality that involves more than a mere “blob of tissue.”
Two years ago the university administration posted advisory signs around the perimeter of the display, stating, "The exhibit is protected under the relevant sections of the Charter of Rights and Freedoms related to Freedom of Expression."
Campus Pro-Life Vice President Drew Brown stated at the time, "While the university may not share the view of CPL, their provision of security and protection of our fundamental freedoms sets an example for universities across the country. Several Canadian pro-life clubs have been denied their right to display GAP like CPL did yesterday. We commend the University for recognizing our Charter rights."
In 2005 university officials, after attempting to ban the display from campus, set up checkpoints and roadblocks in the wake of a vandal who tried to destroy the Genocide Awareness Project pro-life display.
U of C student Joshua Nugent said, "It's like a totalitarian regime in there. Ironically, driving onto campus is like crossing the border from a democratic country where we have free speech to a dictatorship which suppresses speech."
The GAP display will take place on the U of C campus on November 26 and 27, 2008. For more information contact Leah Hallman, president of Campus Pro-Life at U of C, at , or via cell phone at 403-808-3412.

English Catholic Bishops have Failed to Admit “Sickness” of Dissent in the Church: Lancaster Bishop
By Hilary White
ROME, November 19, 2008 (LifeSiteNews.com ) – In a lengthy interview, Bishop Patrick O’Donohue of Lancaster, UK, said that English Catholic bishops have “been inhibited about openly admitting the sickness” and “widespread dissent” from authentic Catholic moral teaching in the Church.
Speaking to Dominic Baster of Zenit, a Rome-based Catholic news agency, Bishop O’Donohue said, “If we fail in our duty of presenting the truths of the faith, it is not only the Church that suffers, but also wider society.”
Earlier this year, Bishop O’Donohue issued a pair of documents calling for radical reforms to the Catholic schools in his diocese and to the Catholic Church in England in general. The publication of “Fit for Mission? Church,” and “Fit for Mission? Schools,” brought both high praise from the Vatican and condemnation from secularists in Parliament. More significant, perhaps, has been the silence of the rest of the Catholic hierarchy of England and Wales on both documents.
The bishop said the problem of widespread dissent and secularisation has stemmed from a misapplication of mass education since the Second World War. While the wider availability of higher education has provided many benefits, it has had its “dark side,” he said. These have included the growth of anti-human and anti-religious philosophies such as radical skepticism, positivism, utilitarianism and relativism.
“Taken together,” he said, “these intellectual trends have resulted in a fragmented society that marginalizes God, with many people mistakenly thinking they can live happy and productive lives without him.”
Education in these philosophical trends, he said, has led to the corruption in the Church. Educated Catholics who were “most exposed to the intellectual and moral spirit of the age,” have gone on to hold positions of influence and authority in the Church and have spread their “so-called loyal dissent, causing confusion and discord.” In addition, he said that the “relentless diatribe” against Christianity in the popular media “has undermined the confidence of the ordinary faithful in the Church.”
Bishop O’Donohue’s analysis was borne out in the reaction to his two documents on schools and the Church. He told Zenit that he was “surprised” both by the level of support and of “hostility” he received in and out of the Church.
“All I have done is reiterate and explain the teachings of the Church as expressed in the documents of the Second Vatican Council and the Catechism of the Catholic Church.
“Many read the documents as my attempt to turn the clock back. This is not my intention at all. What this dismissive response reveals is my critic's rejection of a fundamental component of Catholicism,” he said. “We must challenge this poverty of imagination regarding the communication of the fullness of the faith,” he added.
So outraged were secularist MPs by the bishop’s requirement of Catholic orthodoxy in his schools, that they demanded his presence at a Commons Committee hearing where he was accused of trying to establish religious “fundamentalism.” His insistence on crucifixes in every classroom, "sex-education" based on the principles of chastity and the sanctity of marriage, no school fundraising for anti-life groups, and religious education based firmly in the Catechism of the Catholic Church, infuriated authorities who had grown accustomed to a less forthrightly orthodox Catholic school system.
In the second document, “Fit for Mission? Church,” Bishop O’Donohue called for the restoration of the full adherence to Catholic teaching on faith and morals in the Catholic institution of England and Wales, long known as one of the most “liberal” of the world’s national hierarchies. In the second document, he asked, “Have we forgotten what it means to be Catholic?”
“We have all witnessed with alarm many who profess to be Catholics disavowing the Church's teaching authority ... dismissing apostolic traditions and the doctrines of the Fathers and giving the place of honour to the fashionable opinions of society.”
Concluding his remarks to Zenit, Bishop O’Donohue said, “It is easy sometimes to become despondent about the state of the Church in England and Wales,” but added that the hope of the Church lies in the Resurrection of Christ.
“The principle challenge,” he said, “is the rejection of obedience in the Church, due to the modern emergence of a secularist-minded people.”
“The idea of obedience and humility toward God's truth are totally alien to many in this age of assertive individualism.
“To avail ourselves of the riches of God's doctrine we must not approach it with the attitude of consumers, who pick and choose according to taste and personal comfort. We must allow the word of God to judge and challenge us, and sometimes this is hard and uncomfortable.”

Speech Police Hired to Roam Queens University Campus
By Tim Waggoner
KINGSTON, ON, November 19, 2008 (LifeSiteNews.com) – Queens University in Kingston, ON is coming under criticism for hiring six "dialogue facilitators" to roam its campus and intervene in student conversations in order to promote “diversity” and deal with what they deem to be any “offensive" material.
The six graduate students from diverse backgrounds have been hired to encourage discussion on race, gender, sexual orientation, ethnicity and other social issues, as well as step-in when they hear conversations that could be deemed "offensive." Each facilitator went through an 11-day training course to prepare them for their roles and have been granted free room and board as well as a yearly stipend as payment.
Critics of the program are questioning what constitutes offensive language, and are worried this initiative will be a step towards effectively squashing free speech rights on the Canadian university.
Social conservatives in Canada have in the last several years expressed increasing alarm at escalating efforts to silence “offensive” speech – efforts that, in practice, have led primarily to the targeting of those with politically incorrect views, particularly Christians with traditional views on sexual morality.
"As Catholics we are very concerned about this because the Church teaches that practicing homosexuality is sinful and homosexual sexual orientation is disordered," said Suresh Dominic, spokesman for Campaign Life Catholic, about the university’s program. "I am wondering now if Catholics at Queens are going to be discriminated against for openly stating their faith."
Dominic's comments are especially significant in light of the number of Canadians who have been brought before the Canadian Human Rights Commission (CHRC) in the last 5-10 years for having defended Christian teaching on homosexuality.
Section 13-1 of the Human Rights Act gives the CHRC authorities the power to deem some speech "hate speech" and has been used quite liberally in attempts to charge many outspoken commentators for committing "hate crimes." These include Christian pastor Steve Boissoin, who was fined and ordered to apologize by a human rights tribunal after publishing a letter to the editor in a local newspaper, expressing his disagreement with homosexual “marriage,” and Scott Brockie, a Christian printer who was fined for refusing to print materials for a homosexual organization.
In a LifeSiteNews.com interview, Theresa Gilbert, executive director of National Campus Life Network, echoed Dominic's concerns, questioning what the "facilitators" might deem to be "offensive."
"We have already had clubs across Canada opposed, banned or discriminated against regardless of what they do but merely because of the fact that they are pro-life," said Gilbert. "Will pro-life students at Queens be discriminated against for their perfectly legitimate pro-live views?"
Other opponents of the Queens program have made jabs at the fact that students are being paid to eavesdrop on other students' conversations – a factor that could suffocate rather than promote constructive conversation on social issues.
"Having a program like this in place could stifle public discussion if people are worried their private conversations are being monitored," said Angela Hickman, managing editor of the Queen's Journal, as reported by the Globe and Mail. "For a lot of people, their opinions get formed in conversations and so stifling that is dangerous."
An editorial in the Queen's Journal said the program "seems to be an inadequate, lacklustre attempt to deal with social inequalities—and especially racism—on campus."
"It's unlikely six facilitators in a crowd of thousands will have much impact on fostering dialogue in residences," it reads.
"On the other hand, if they do become regularly involved in conversations, they risk hostility from students who don't want to be approached in what they consider private social settings. The resulting dialogue likely won't be productive or effective if students feel they're being cornered and become defensive."
Book Review: The Tyranny of Nice – How Canada Crushes Freedom in the Name of Human Rights
The uncommon nonsense of the Canadian Human Rights Commissions
By John Jalsevac
November 13, 2008 (LifeSiteNews.com) – If there is any fatal flaw to be found in this handy little volume jointly authored by Kathy Shaidle and Pete Vere it is simply this: it runs the risk of not being believed. That is, it may not be believed because most people still abide by the belief that most other people are decent and reasonable chaps, and that being a decent and reasonable chap isn’t an indictable offense.
This conviction of the commonness of decency and reason especially holds true for those who live in modern, Western democracies. For a democracy makes absolutely no sense and cannot function without its cornerstone principle: the notion that common sense is much more common than its opposite – what G.K. Chesterton termed “uncommon nonsense.” This notion is what gives any democracy the fundamental faith that the people (demos), when left to their own devices, can usually be trusted to make decent and reasonable choices.
But in any democracy there are exceptions. Usually these exceptions are found in those who would set themselves up as the ruling class: which is why the citizens of any healthy democracy have a healthy distrust of their politicians and their bureaucrats.
Indeed, in your typical democracy, most of the uncommon nonsense can be found concentrated to a disproportionate degree amongst the elite – the politicians, the bureaucrats, and the intellectuals, who are more often guided by ideology (i.e. balderdash, rubbish) than by common sense. This is why checks and balances (not to mention the political cartoon), were invented.
Canada is no different in this regards. If anything this is more true of Canada than any other democracy: for in the Great White North we have the bureaucrats of the Canadian Human Rights Commissions, who, when compared to your average Canuck, are so out to lunch that they remind one of Lig Lury, Jr. He is the fictional editor of “The Hitchhiker’s Guide to the Galaxy,” whose lunch breaks became ever more extravagant and legendary in length until one day he left for lunch and never returned, but who, nevertheless, is popularly believed to be on his lunch break still.
That’s how out to lunch the CHRC bureaucrats are. But don’t take my word for it. Read The Tyranny of Nice.
As the authors of this slim volume reveal, in the disconnected world of the commissions perfectly decent and reasonable chaps – model citizens like Steve Boissoin, Ezra Levant, Mark Steyn, Scott Brockie, Ted Kindos, Fr. Alphonse de Valk and Mark and Connie Fournier, to name but a few – can be prosecuted for no other crime than that they aren’t as liberal and loony as the employees of the CHRC. For having dared to “offend” the sensibilities of one of the protected groups (mostly homosexuals and Muslims), these individuals have had their pocketbooks emptied by legal fees well into the tens of thousands of dollars, their reputations dragged through the mud, and their nerves shot by the strain of “investigations” that span up to half a decade in length.
And all of this without any decent hope of actually winning their case. For up until recently (coincidentally, about the same time the high-profile Mark Steyn case began drawing unwelcome attention to the commissions’ closed-door machinations) the human rights tribunals had a mind-boggling 100% conviction rate for so-called “hate crimes.”
“In the upside down parallel universe that is the Canadian Human Rights bureaucracy,” write Shaidle and Vere, “truth is no defense, intent is irrelevant, one is guilty until proven innocent, and the lucky complainant’s legal costs are covered by the province’s taxpayers – while the accused is obliged to spend thousands on his own defense in the almost certain knowledge that he will lose anyway.”
That may sound like hysteria. It is unfortunate that it is the unadulterated truth, a truth that Vere and Shaidle provide plenty of hard evidence to prove.
Indeed, this humble pair has done a great service for those who are concerned about the future of democratic freedoms in Canada. They have pulled together in one short, easy-to-read, 80-page volume, a goodly portion of the lunacy of the commissions, well documented and entertainingly presented; and the end result is to leave no question that the commissions amount to a serious threat to freedom in Canada and that something must be done about it.
The question, however, as previously suggested, is whether your average reader is prepared to accept what Shaidle and Vere have to offer, no matter how straightforward the facts may seem.
Will your average Canuck swallow the fact that their human rights tribunals once decided that requiring an employee at a fast-food restaurant to wash her hands violated her human rights? That they actually wrote, "There was no evidence of: the relationship between food contamination and hand-washing"? Or that asking a patron at a bar and grill not to smoke marijuana in the doorway violated his human rights? Or that a tribunal is currently "investigating" the case of a stand-up comedian who heckled his hecklers because this may have violated their human rights?
These, of course, are merely some of the oddest cases the CHRC has agreed to hear, which in their bizarre novelty reveal just how disconnected the commissions are. But there are, of course, the much more dangerous and equally unbelievable cases: the one where a Christian pastor was fined and told to apologize to his accuser for having expressed his disagreement with homosexual "marriage" in a letter to the editor of a reputable local paper; or the one where one of Canada's most widely read magazines had to answer for having published an excerpt from a book that was on the New York Times' best-sellers list at the time; or the one where a Catholic magazine had to defend itself merely for having defended the Catholic Church's teachings on the morality of homosexual behavior.
Will these things be accepted, or will the average reader merely react with suspicion, wondering if Shaidle and Vere are not making things up, or presenting only one side of the story? This is, in my opinion, a valid concern.
The Human Rights Commissions are so far left of the majority of Canadians, that many will have a hard time swallowing the claim that a government agency is really doing what this government agency has been doing for years. It seems such an improbable story, especially when so little mention of it has been made in the mainstream media, which is perhaps the only other institution in Canada that is almost as loony as the CHRC.
Interestingly, if you had asked me these questions only a few days ago I would have said with conviction that most Canadians were not prepared to accept the thesis of The Tyranny of Nice. But things have changed since then. Last weekend, at the Conservative Party convention, well over 90% of the 2,000 delegates present voted to significantly curtail the powers of the human rights commissions to prosecute “hate speech.”
On the face of it, this isn’t a revolutionary step. The resolution is non-binding, and Conservative higher-ups have consistently shown a startling resilience against taking notice of the elephant in the living room. However, the overwhelming support from grassroots delegates for motion P-203 revealed that, despite the deafening silence of the mainstream media, and despite the total inaction from the higher-ups, everyday Canadians are starting to wise-up to the CHRC racket.
That this is so is largely thanks to out-of-the-mainstream writers and journalists such as Pete Vere and Kathy Shaidle, not to mention better-known figures such as Ezra Levant and Mark Steyn, who have been anything but demure in their criticisms of the commissions.
Indeed, Mark Steyn himself penned the introduction to The Tyranny of Nice. The ten bucks the book costs is well worth it just for the introduction alone, which is guaranteed to offend the CHRC bureaucrats, and to make the rest of us who still have our humor gland intact laugh out loud.
The Tyranny of Nice is an excellent and necessary book, a first step in educating Canadians and non-Canadians alike on the threat of the human rights commissions and what can be done about them. Buy it, read it, and, most importantly of all, act on it.
As Vere and Shaidle conclude, “Canadians … must come together and abolish Canada’s human rights racket. They must do so before the damage inflicted upon our nation’s social fabric becomes irreversible. …
“To quote Levant: Fire. Them. All.”
Indeed.

Adult Stem Cells used to Create “Living Bandage” for Knee Injuries
By Hilary White
BRISTOL, UK, November 19, 2008 (LifeSiteNews.com) – A team of scientists at Bristol University has created a living “bandage” from adult stem cells that can be used to heal common sport injuries.
Among the most common sport injuries in Britain, a nation of football (soccer) fans, is a tear in the cartilage of the knee. Every year, more than 80,000 people in Britain suffer tears to mensical cartilage. Repairs to knee injuries have until now been restricted to surgical treatments, including removal of cartilage and transplantation. The majority of meniscal tears are not suitable for repair and instead the torn piece is removed. Removal of the meniscus cartilage can lead to progressive, degenerative arthritis of the knee joint.
In the Bristol university experiment, cartilage-producing stem cells taken from 23 patients with knee injuries, were coaxed to grow and coat a sponge-like scaffold, made from hyaluronic acid - a compound that occurs naturally in cartilage. The scientists applied this cellular “bandage” to the inside of tears in knee cartilage in the lab.
After two weeks of growth, the cells and scaffold were inserted to fix tears of up to 11 square centimetres in the knee cartilage of the patients. The two halves of the tear grew back together. The team, led by Anthony Hollander, a professor of rheumatology and tissue engineering at Bristol University, told the New Scientist, “We found the cartilage matures well, even in patients with early osteoarthritis.”
In related news, Bristol University has reported that the world’s first tissue-engineered trachea (windpipe) has been created using a patient’s own stem cells. This tissue-engineered airway has all the “mechanical properties” that permit normal breathing, saving the life of the patient, a 30 year-old mother of two who suffered a collapsed airway following a severe case of tuberculosis.
Doctors considered removing the woman’s lung, but were concerned by the high risk of complications and high mortality rate with such a procedure. Instead, stem cells were obtained from the woman’s own bone marrow, grown into a large population and matured into cartilage cells. These were then “seeded” with tracheal cells. This procedure created a graft that was used to replace the patient’s left main bronchus.
Professor Macchiarini, lead author on the paper, said, “We are terribly excited by these results. Just four days after transplantation the graft was almost indistinguishable from adjacent normal bronchi. After one month, a biopsy elicited local bleeding, indicating that the blood vessels had already grown back successfully.”
In addition, the university said, the new trachea is free from the risks of immune system rejection seen with conventional transplanted organs.
A media release from the university said, “These remarkable results provide crucial new evidence that adult stem cells, combined with biologically compatible materials, can offer genuine solutions to other serious illnesses.”
Dr. Anthony Hollander said, “This successful treatment manifestly demonstrates the potential of adult stem cells to save lives”
Lawsuits Proliferate Demanding Proof of Obama's Natural-Born Citizenship before Electoral Vote Count
Keyes warns against "an unprecedented and looming constitutional crisis"
By Kathleen Gilbert
November 19, 2008 (LifeSiteNews.com) - A Sacramento Supreme Court petition filed on behalf of Alan Keyes and others has asked the Secretary of State to withhold the state's 55 electoral votes from the December Electoral College tally until President-Elect Barack Obama proves he is eligible to take office.
The court document joins a host of litigation questioning Obama's eligibility in as many as 15 states, with confirmed cases in Ohio, Connecticut, Washington, New Jersey, Pennsylvania, Georgia and Hawaii, and unconfirmed reports from Utah, Wyoming, Florida, New York, North Carolina, Texas, California and Virginia, according to WorldNetDaily.
All the cases reported to have failed were dismissed due to the plaintiff's lack of standing, without the court actually investigating the complaint.
However, as Keyes was on the November ballot as the American Independent Party presidential candidate, his is the first case in which the plaintiff is a candidate who lost the presidency, perhaps illegitimately, to Obama. This may mean that Keyes' case will be the first in which the plaintiff is deemed to have sufficient standing, leading the court to investigate the complaint instead of dismissing it.
"Should Senator Obama be discovered, after he takes office, to be ineligible for the Office of President of the United States of America and, thereby, his election declared void, Petitioners, as well as other Americans, will suffer irreparable harm in that an usurper will be sitting as the President of the United States, and none of the treaties, laws, or executive orders signed by him will be valid or legal," Keyes wrote to the Sacramento Supreme Court.
"An unprecedented and looming constitutional crisis awaits if a President elected by the popular vote and the electoral vote does not constitutionally qualify to serve in that capacity," the court document continued.
In response to questions about why the suit was being filed, Keyes commented, "I and others are concerned that this issue be properly investigated and decided before Senator Obama takes office. Otherwise there will be a serious doubt as to the legitimacy of his tenure.
"I hope the issue can be quickly clarified so that the new President can take office under no shadow of doubt," concluded Keyes. "This will be good for him and for the nation."
According to the United States Constitution, only a natural-born American citizen is eligible for the office of the presidency. Questions and rumors about President-elect Obama's birthplace and legal citizenship gained steam in the weeks leading up to the election, and continue to fly as Obama refuses to release his original birth certificate and medical records to the media (http://www.lifesitenews.com/ldn/2008/oct/08102712.html).
The Obama camp dismisses the charges as "garbage." But without the demanded proof, purported evidence that Obama was born in Kenya or else lost his natural-born citizenship in Indonesia continue to gain notoriety on the internet, including a Youtube video of Obama's Kenyan grandmother saying the Illinois senator is native to her Mombosa village. (http://www.youtube.com/watch?v=-4FqVRWgrNw&eurl=http://blog.barofintegrity.us/2008/11/01/barack-nate-dhalani.aspx?ref=rss)
Obama claims to have been born in Hawaii, and has released an image of a Hawaiian certification of live birth. This did not satisfy some skeptics, however, who insist the image was forged.
One case, filed by lifelong Democrat Philip J. Berg of Philadelphia, is currently before the Supreme Court. The defendants, including Obama and the Democratic National Committee, have until December 1st to respond to Berg's appeal to the Supreme Court. The district court judge that first heard Berg's case had told Berg he did not have standing to bring charges.
Berg told LifeSiteNews.com that more court activity across America calling for the withholding of electoral votes until the matter is settled, like Keyes' petition, is likely.
Berg says he is very optimistic about his pending case, and says he is certain the Supreme Court will not be able to ignore the issue. "Our government is based on the U.S. Constitution, we're asking for the enforcement of certain terms here that are very basic," he said.
"I think this is the biggest hoax perpetrated upon the American public in the history of our country, and I really think certain people should end up going to jail," Berg added.
Berg warned that, if Obama truly is ineligible, and nonetheless inaugurated, there would be "a real constitutional crisis.
"We'd have a nightmare on our hands," he said.

Mainstream Media Ignoring Violence, Vandalism and Intimidation of Homosexualist Protestors
Commentary by Brian Fitzpatrick, Senior Editor, Culture and Media Institute
November 19, 2008 (LifeSiteNews.com) - A wave of quasi-fascism has descended upon California and touched several other states. But instead of exposing the abuse, the media are ignoring it.
On November 4, California voters approved Proposition 8, the state constitutional amendment declaring that only marriages between a man and a woman are valid in the Golden State. Since then, militants have vandalized property, threatened individuals and mailed white powder to Mormon churches. Most Americans probably are not aware of this fascistic behavior, because the media – the people who are supposed to be the first line of defense against domestic tyranny – are absent.
Fascism is a powerful word, but often used imprecisely, so let’s define our terms. The following definition comes from former Columbia historian Robert O Paxton, author of The Anatomy of Fascism:
"A form of political behavior marked by obsessive preoccupation with community decline, humiliation or victimhood and by compensatory cults of unity, energy and purity, in which a mass-based party of committed nationalist militants, working in uneasy but effective collaboration with traditional elites, abandons democratic liberties and pursues with redemptive violence and without ethical or legal restraints goals of internal cleansing and external expansion."
How does the term “fascism” apply to America? A national network of angry gay rights demonstrators is screaming for the use of force – judicial force – to nullify Prop. 8. They’ve committed numerous acts of verbal abuse and physical violence (check out the account and video of Christian evangelists being hounded out of San Francisco’s Castro district) and are openly seeking revenge against churches and businesses that supported Prop. 8. As they did previously in Massachusetts, they have uncovered lists of citizens who supported marriage and targeted them for abuse and boycotts. Is this a form of Paxton’s “internal cleansing?”
This network of homosexual protesters is far from nationalistic, but otherwise it’s quite similar to Paxton’s definition. It’s easily seen as a “mass-based cult of unity or energy,” motivated by perceptions of victimhood, and abandoning “democratic liberties” to pursue its goals without the ethical and legal restraints customary in American politics.
This mass movement is also collaborating effectively, but not at all uneasily, with traditional elites. First, the politicians. Same-sex “marriage” has been imposed in three states by rogue courts and governors who ignored the rule of law—Massachusetts, California and most recently Connecticut. Prop. 8 was a popular backlash against the California Supreme Court edict. Now Gov. Arnold Schwarzenegger is calling for the court elite to strike back by declaring Prop. 8 unconstitutional. California Attorney General Jerry Brown, an outspoken supporter of gay “marriage,” is calling for the court to issue a new decree quickly. California’s top elected officials want the court to overrule the clearly expressed will of their own citizens.
Maybe “citizens” is the wrong word. Citizens govern themselves. Golden State elites seem to be turning Californians into subjects.
On to the news media elites. Democracy itself is under attack in California, and what are the supposed watchdogs of freedom, the free press, doing about it? When they’re not applauding, they’re strategically averting their eyes.
Within two days of the popular passage of Prop. 8, the media began defining the story as gay civil rights denied, rather than civilization defended. Media outlets began to caricature supporters of Prop. 8 as bigots, and refused to allow them to tell their side of the story. The prevailing media attitude toward legalizing same-sex “marriage” is exemplified by a five minute, on-air editorial by MSNBC’s resident attack dog, Keith Olbermann. Olbermann called the Prop. 8 vote “horrible, horrible.” The poor guy was so emotionally distressed, he forgot to shout.
The moral credibility of homosexual agitators is based on public perception that they are “victims,” so the media have virtually ignored numerous examples of gay activists victimizing their political adversaries. Broadcast television networks have failed to show gay protesters hurling racial and religious epithets at African-Americans and Mormons, two groups largely responsible for Prop. 8’s victory. Normally, such outright bigotry would be front page news.
The media are even ignoring sacrilege and violence. Until Bill O’Reilly showed a video clip on Nov. 17 on Fox News, only one major newspaper, and no broadcast networks, covered the carefully planned Nov. 9 assault of Mt. Hope Church in Lansing, Michigan, by homosexual activists during a worship service. No national networks, to the best of our knowledge, have shown the dramatic footage at Palm Springs City Hall of screaming protesters roughing up an elderly counter-protester, tearing a cross from her hands and stomping on it.
Even a reprise of the anthrax scare has gone almost unreported. Only a handful of newspapers and NBC’s Today show have noted that domestic terrorists have sent packages containing white powder to Mormon churches.
Entertainment media elites are getting their licks in, too. CNN reported yesterday that Roseanne Barr, for example, said African-Americans are “as bigoted and ignorant as their white Christian white right wing counterparts.” Ah, the sweet sound of tolerance.
America hasn’t yet seen political violence of the kind that led to takeovers of Germany and Italy by Fascist thugs before World War II. But if media outlets don’t investigate these incidents, expose the perpetrators, and pressure the government to press charges, we can only anticipate greater political violence.
Eventually, the media themselves will be the targets.
Catholics and Evangelicals Urge Intense Prayer Against Abortion for Coming Obama Rule
By John-Henry Westen
WASHINGTON, November 19, 2008 (LifeSiteNews.com) - Some of the most intense prayer ever requested of Christians is being demanded by Catholics and Evangelicals alike in the wake of the election of Barack Obama and his impending signing of the Freedom of Choice Act. The Act would undo any restrictions on abortion and force taxpayer funding of the killing. While Catholics are calling for intense Eucharistic adoration even up to nine hours straight, Evangelicals are calling for stadiums to be filled with Christians praying and fasting.
Lou Engle, one of the founders of the prayer movement to end abortion known as bound4life, had a post-election message for the Pro-Life Movement Monday reminding Christians that "abortion is a spiritual battle." Therefore, he continued, "let this election be a call to prayer and fasting like has never been seen in America. We must have a spiritual awakening to turn the hearts of this nation and I believe we will have this awakening! As my friend Allen Hood prophesied, 'Let it be said that in the days of the rule of President Obama, stadiums were filled with prayer and fasting.'"
Similarly Catholics with a group known as Our Lady of America have launched the "First Eucharistic Vigil for America: 48 Hours of Eucharistic Prayer From 6:00 p.m., Friday, November 21st (The Presentation of Mary) until 6:00 p.m., Sunday, November 23rd (Christ The King)." Organizers ask the faithful to "arrange to make a vigil (3-9 hours) [or at least one Holy Hour] before Our Lord Jesus Truly Present in The Most Blessed Sacrament sometime between Friday Evening and Sunday Evening. Prayer intentions for the vigil are:
For the end to all legalized abortion, and to stop any new pro-abortion or pro-infanticide laws, including defeat of the FOCA ("Freedom of Choice Act") [read about the FOCA threat];
For the United States Catholic Bishops to process solemnly and to install into the National Shrine of The Immaculate Conception at Washington the statue of Our Lady of America with the Lily of Purity extended from Her right hand for the protection of America [read the Messages of Our Lady of America];
For His Holiness, Pope Benedict XVI, and for the U.S. Catholic Bishops, and North American government leaders to achieve greater respect for human life and and for the virtue of purity.
Adult men, in particular, are called to this Vigil through the night from 10:00 p.m. to 7:00 a.m., remaining, if possible, for an efficacious novena of nine (9) hours, or at least for one (1) to four (4) hours during the nocturnal periods from late Friday to early Saturday, or late Saturday to early Sunday. Before Friday evening, participants are urged to go to Confession before the Vigil and attend Mass every day. Those wishing to acknowledge participation may email:
Both groups realize full well the evil of abortion and homosexuality and that the Obama Administration is set to expand on both those fronts. Nevertheless neither group espouses hatred. "We must pray for President Obama, he is not our enemy," says Engle. "Pray that God would give him wisdom. If God could change a Nebuchadnezzar by haunting with dreams, he could change Obama. Our mandate is not to curse but to pray for those in authority."
Engle concluded: "God has set before me two great objectives, 'God end abortion, and send revival to America.' Let this be the cry of the Pro-Life Movement in America today."
