VANCOUVER, Jan 15 (LSN) - B.C. Supreme Court Justice Duncan Shaw has struck down the section of the Criminal Code that prohibits the possession of child pornography. In a judgement released today, Shaw wrote: “There is no evidence that demonstrates a significant increase in the danger to children caused by pornography.” The judge sided with defendant John Sharpe who’s home was raided in April 1995 by police who found photos, CD’s and writings about child pornography. Sharpe argued that his rights to freedom under the Charter include the right to child porn.
