SEATTLE, October 16, 2002 (LSN.ca) - A divorced couple’s battle over frozen embryos they once contracted to create could establish a precedent that favours the right to life, lawyers claim. Courts in the U.S. have ruled on embryo custody disputes in the past, but in this case the embryos do not have genetic material from both parties—because the former husband and wife contracted with a Loma Linda University laboratory in California to fertilize eggs from a donor with sperm from ex-husband David Litowitz. Mr. Litowitz wants the embryos destroyed against the wishes of his former wife, Becky. Her lawyers are trying to establish that the embyros are human life deserving of protection from harm. “Our position is that human embryos are indeed a sanctified form of human life and need to be given the respect that goes to human life,” said Richard Ackerman.
