TAMPA, March 22, 2005 (LifeSiteNews.com) - A federal judge in Tampa - appointed by former US President Bill Clinton - refused to order the re-insertion of Terri Schiavo’s feeding tube, claiming that her best interests have already been well represented in court.
US District Judge James Whittemore’s ruling early Tuesday signalsÂthat Terri’s parents, Robert and Mary Schindler, have little hope in succeeding with their case. “This court concludes that Theresa Schiavo’s life and liberty interests were adequately protected by the extensive process provided in the state courts,” Whittemore concluded in his 13-page ruling.
The Schindler’s attorney said they plan an immediate appeal to the 11th U.S. Circuit Court of Appeals in Atlanta. A decision on the appeal is expected shortly, but sources close to the case have informed LifeSiteNews.com that the appeal will likely be rejected.
Whittemore claimed that the Schindler’s “(offered) no authority” that Florida state Judge George W. Greer “compromised the fairness of the proceeding or the impartiality of the court by following Florida law.”
