ANCHORAGE, Alaska, May 5, 2009 (LifeSIteNews.com) - A member of the US Air Force has been sentenced to almost 10 years in prison after he was found guilty of inducing a miscarriage by poisoning his wife’s food with Misoprostol, one of the prostaglandin drugs used in the chemical abortifacient RU-486 procedure.

Airman First Class Scott Boie of Milton, Wisconsin, stationed at Elmendorf Air Force Base in Alaska, was convicted in a court-martial of attempting to kill an unborn child under the Uniform Code of Military Justice, and the Unborn Victims of Violence Act which states that any person who causes "the death of, or bodily injury to a child who is in utero" is guilty of a federal offense.

The court-martial heard that Boie crushed the Misoprostol pills, which he obtained as a medication for stomach ulcers, into his wife Caylinn’s food, after she refused to have an abortion when she discovered she was pregnant.

Evidence introduced at the court-martial showed Boie’s computer had a Google search for "at-home abortion methods."

Caylinn miscarried a week after unknowingly taking the drug.

Boie was originally charged with "intentionally killing" the unborn child, which carries a maximum sentence of life without parole, but was convicted of the lesser charge of "attempting to kill" his unborn child.

The court-martial also charged Boie with assault on his wife, and with an unrelated charge of theft and arson in relation to stealing a truck and then setting it on fire.

Air Force Deputy Staff Judge, Major Shane Cohen, said Boie, "pled not guilty to the intentional killing of the unborn child but pled guilty to the attempt. With respect to the arson he pled guilty, and to the assault consummated by battery he pled guilty."

The United States Unborn Victims of Violence Act (UVVA), also known as "Laci and Conner’s Law" (2004), declares that all children "in utero" are considered a second-and distinct-victim of violence in the case of assault on the mother, and forces the courts to recognize two victims in a violent crime committed against a pregnant woman, which results in the harm or death of her unborn child. Twenty-nine states have already passed similar legislation, and more than 80% of Americans favored the passage of the federal ‘Unborn Victims’ bill.
