TORONTO, May 12, 2014 (LifeSiteNews.com) – Pro-life prisoner of conscience Mary Wagner’s trial continues Tuesday and Wednesday and her supporters are urging pro-life citizens to turn out at the court to support her.

As part of her trial, Wagner is moving to challenge the current status of human being in Canadian law as applying only to those fully born.

Wagner’s supporters are also asking pro-lifers to help in defraying the costs of her constitutional challenge, which will include the expenses of flying in and accommodating the expert witnesses.

“The mission is to fill that court room, which has a capacity of 60 persons, especially on May 13,” Wagner’s friend John Bulsza told LifeSiteNews.

Bulsza explained that this step in the trial is extremely important because Mary and Dr. Charles Lugosi, her lawyer, must make the case that she has standing for her defense, and the defense of all unborn children, based on constitutional arguments.

“We will be there to support Mary and Dr. Lugosi, and impress upon Judge Fergus O'Donnell the importance of this case and the importance of letting Mary's case proceed to the expert witnesses and conclusion of the trial,” he said.

Mary is on trial after pleading not guilty to charges of mischief, interference with lawful enjoyment/operation of a business, and breach of a court order, for entering the “Women’s Care Clinic” on Lawrence Avenue West in Toronto in August, 2012. Her intention was to offer abortion-bound women a rose and plead for the lives of their children.

Mary has been imprisoned since that time because she declines to agree to bail conditions that include staying away from abortion sites.

“Mary is compelled by her conscience to disobey her probation order, because the law permits the self-defense of other human beings,” said Dr. Lugosi. “Mary uses roses, conversation, and literature in a peaceful non-violent and respectful manner to try to stop an imminent fatal assault upon unborn human beings by placing fetuses who are about to die under her protection.”

Dr. Lugosi argues that Mary's actions are legal under section 37 of the Criminal Code of Canada, which justifies actions to defend “any one” under a person's protection from assault. The argument will contend that “any one” includes unborn children.

The trial takes place tomorrow, May 13th, at 10 a.m. in the Ontario Court of Justice, 1000 Finch Ave. West at Dufferin Street, Toronto.

At the 2014 National March for Life Rose Dinner, pro-life heroine Linda Gibbons came to the mic to encourage pro-lifers to support Mary with prayer and to be present at the trial if possible, but also informed the packed conference hall that a benefit dinner for the Mary Wagner Defense Fund is planned to take place in Toronto on May 29, 2014.

Linda will be hosting the funding-raising dinner at the Canadian Christian College, 50 Gervais Drive, Toronto, and will be giving an update on the results of the May 13/14 hearings, along with information about the upcoming proceedings.
