(LifeSiteNews) — The Lindsay Clancy jury has again sent a note to the judge indicating that they remain deadlocked, increasing the likelihood that the proceedings will end in the judge being forced to declare a mistrial.
“It definitely seems at this point that we are headed toward a mistrial,” Fox News contributor Donna Rotunno noted in a live report outside the Plymouth (Massachusetts) County Courthouse.
Judge William Sullivan sent the jury back to deliberate, asking them to find common ground after they had sent a similar message to him yesterday. But 10 hours of additional deliberations failed to produce a unanimous decision among the three men and nine women on the jury panel.
The judge again encouraged the jurors to try one last time to find compromise, as a last resort reading them a Tuey-Rodriguez charge:
The verdict must represent the considered judgment of each juror. In order to return a verdict, it is necessary that each juror agree to that verdict. Your verdict must therefore be unanimous.
It is your duty as jurors to consult with one another and to deliberate with a view to reaching an agreement, if you can do so without violating your individual judgment and conscience. Each of you must decide the case for yourself, but you should do so only after considering the evidence impartially with your fellow jurors. In the course of your deliberations, do not hesitate to reexamine your own views and change your opinion if you become convinced that it is erroneous. But do not surrender your honest conviction as to the weight or effect of the evidence solely because of the opinion of your fellow jurors, or for the mere purpose of returning a verdict.
You are not partisans for one side or the other. You are judges, the judges of the facts. Your sole interest is to ascertain the truth from the evidence in the case.

If after a last round of deliberations they remain at an impasse, a mistrial will be declared and the whole courtroom process will repeat.
On January 24, 2023, 32-year-old Lindsay Clancy, a former labor and delivery nurse, sent her husband Patrick to pick up takeout food and go to the pharmacy. Then she strangled her three young children – 5-year-old Cora, 3-year-old Dawson, and 8-month-old Callan – with rubber exercise bands, slashed her own wrists and neck, and threw herself out of a second-story window. Patrick returned to find two of his children dead in the basement and his wife bleeding outside. Callan died in the hospital three days later.
The prosecution has stated that Clancy “acted intentionally, rationally and swiftly” rather than in a moment of postpartum psychosis; she very deliberately planned the murders by researching them ahead of time and ensured her husband was out of the house. The defense insists that the killings were triggered by a lethal combination of psychiatric medications and her postpartum struggles.
