MONTREAL, Jan 6 (LSN)—Quebec homosexual Martin Dube is challenging the province’s Civil Code to legally sanction his “marriage” to his lover.  Dube claims that his rights under Quebec’s Charter of Rights and Freedoms are being violated by the province’s failure to recognize his so-called marriage as legitimate.  Dube’s partner is a foreigner and would be granted easy access into Canada if the province gave legal recognition to the “marriage.”  Dube’s lawyer Stephane Gendron claimed that Quebec’s Charter of Rights and Freedoms overruled the Civil Code and thus filed a request in Quebec Superior Court on Tuesday to have the code declared discriminatory. The case is to be heard in February.
