DAYTON, September 19, 2001 (LSN.ca) – U.S. District Judge Walter Rice today blocked the state of Ohio from enforcing a ban on partial-birth abortion. Rice called the law unconstitutional citing the U.S. Supreme Court decision overturning a similar ban in Nebraska. The judge said that the procedure was determined to be safer than other late term abortion procedures for some women.

The New York Times reports that the bill had been signed by Gov. Bob Taft in May 2000. It would have made doctors who perform the procedure subject to up to eight years in prison.
