TORONTO, Ontario, August 28, 2012 (LifeSiteNews.com) – Mary Wagner will pursue legal aid and representation by a lawyer as her case winds its way through the court system in the coming weeks. She gave that indication during a brief court appearance as part of the continuation of a bail hearing in the Ontario Court of Justice at College Park Monday morning.

Wagner faces three charges – mischief and two counts of failing to comply with a probation order – after her arrest at the “Women’s Care Clinic” abortion site on Lawrence Avenue East on August 15. During an earlier hearing on August 16, the Crown had declared it would be seeking her continued incarceration pending her guilty plea or a trial.

Through duty counsel, Wagner told the court she will not be consenting to a simple reading of the alleged facts surrounding the charges when the bail hearing continues. She is also seeking disclosure of the Crown’s documents in connection with the charges. A justice of the peace remanded Wagner to September 6 at 9 a.m. for an appearance via video in Room 505 of the College Park court.

An appeal of an earlier conviction that resulted in a harsh six-month jail sentence is still due to be heard on September 19 at the Superior Court of Justice at 361 University Avenue in Toronto.
