(LifeSiteNews) — A Michigan county prosecutor said he plans to enforce the state’s 1931 law on abortion assuming the court system upholds his ability to prosecute.
The pro-life law is currently in dispute, due to pro-abortion Michigan Gov. Gretchen Whitmer suing to stop prosecutors from enforcing the law before the Dobbs decision and another lawsuit from Planned Parenthood. A Planned Parenthood donor and former attorney who is now a judge stopped enforcement of the law at the request of the recipient of her donations, but other judges have issued conflicting rulings.
“The United States Supreme Court made a ruling sending the abortion issue to each state to decide to regulate or ban,” Jackson County prosecutor Jerard Jarzynka told M Live. “Michigan has a validly passed law on abortion. I cannot ignore the law and a decision made by the United States Supreme Court.”
He is a defendant in one of the lawsuits filed to stop enforcement of the law.
“I’m going to follow the law,” Jarzynka said Monday. “If a police agency submits a police report for a possible violation of Michigan’s abortion statute, we will review it like we do for any other report for possible charging and it will depend on what evidence is submitted and can we prove a criminal charge beyond a reasonable doubt.”

There is a Planned Parenthood in Jackson County that aborts babies.
Pro-life leaders praised the prosecutor’s statement on enforcing the law.
“I believe that more county prosecutors should follow the law to enforce abortion cases. It is their duty to follow the law as Prosecutor Jerard Jarzynka has stated,” Jackson Right to Life executive director Kathy Potts told LifeSiteNews on Wednesday. “More prosecutors should have the legal integrity and moral fortitude to follow suit. In not doing so, they make a mockery of our legal system choosing to do only what they wish instead of following the law.”
“Governor Whitmer and AG Dana Nessel are using our court system as a political football to achieve their goal of unlimited and unregulated abortion in Michigan,” Potts stated.
“Jarzynka is doing his job. Prosecutor[s] have no right to pick and choose what laws they will or will not enforce. This law that bans abortion in Michigan has never been repealed,” Monica Miller, the director of Michigan-based Citizens for a Pro-Life Society, told LifeSiteNews on Wednesday. “It survived a challenge in 1972 during the height of the sexual revolution. And here’s the bottom line: abortion is murder. Abortion kills people, and for that reason alone the abortionists, and those who aid in the killing of the innocent must be prosecuted for this crime.”
Kristi Hamrick with Students for Life Action shared similar thoughts.
“It’s a little sad that prosecutors following the law is news. The hypocrisy of [Planned Parenthood] and company is on full display these days,” Hamrick stated in her email. “For years they said abortion being legal was the most important factor in the debate. But now, as the law supports life, they take back 50 years of talking points. In states across the country, we hope more of our legal community will protect life in law.”
A group of 90 leftist prosecutors signed a letter after the reversal of Roe v. Wade that stated they would refuse to enforce pro-life laws on the books.
“Enforcing abortion bans runs counter to the obligations and interests we are sworn to uphold,” the group Fair and Just Prosecution wrote. “It will erode trust in the legal system, hinder our ability to hold perpetrators accountable, take resources away from the enforcement of serious crime, and inevitably lead to the re-traumatization and criminalization of victims of sexual violence.”
The signers include several attorneys general, including Michigan’s Dana Nessel.
