EDMONTON, June 18, 2003 (LifeSiteNews.com) – At least one Canadian province will be fighting the federal government’s capitulation to the court-ordered redefinition of ‘marriage’ to include homosexual couples. Commenting last week on the court ruling, Alberta Premier Ralph Klein said, “The law in Alberta is very clear, notwithstanding how some people might feel about it, it’s very clear. It’s as clear as crystal. If there is any move to sanctify and legalize same-sex marriages, we will use the notwithstanding clause, period. End of story.” Alberta Justice Minister David Hancock reacted to the federal government announcement that it was not going to appeal the ruling saying: “We have a definition of marriage in our act and that’s what we will uphold not withstanding the charter.” While marriage is officially defined by the Dominion government, provinces issue marriage licences and Hancock said that the province will refuse licences to homosexual couples. The Notwithstanding Clause, Section 33 of the Canadian Charter of Rights and Freedoms, gives any Canadian province the power to put decisions by the federal parliament or legislature on hold for five years, after which time the province could choose to re-enact the clause.
