TOPEKA, KS, February 20, 2008 (LifeSiteNews.com) – A subpoena issued by a citizen-called grand jury for abortion records in the custody of Attorney General Steve Six has been stayed by Kansas Supreme Court Chief Justice Kay McFarland.

  The now-stayed subpoena asked for 60 abortion records that were obtained by former Attorney General Phill Kline in 2006, which have already had all patient identifying information redacted, and have been certified for release by the Supreme Court to investigative agencies of the Executive Branch. Some of those records are the basis for 19 criminal charges of illegal late-term abortions that Tiller currently faces. The grand jury is investigating Tiller on allegations of having committed illegal abortions on viable babies over a five-year period.

  The Supreme Court said that Six’s motion to stay the subpoena cited similar privacy concerns put forth by Tiller’s attorneys, who earlier moved to block 3 grand jury subpoenas for 2,000 of Tiller’s late-term abortion records.

“This ruling is troubling, given the fact that the records in Six’s custody have already been certified for release by the Supreme Court and deemed to contain no information that could jeopardize a patient’s privacy,” said Operation Rescue President Troy Newman. “Has Justice McFarland become that forgetful?”
 
“Justice is teetering on a razor’s edge. Every effort is being made to keep these records from being examined by this impartial grand jury. Thwarting this grand jury from fully investigating the serious allegations against Tiller is nothing less than the subversion of justice,” said Newman. “The people need to start letting Six know that they will not tolerate further corruption in this matter.”

  Tiller’s attorney, Dan Monna, said that Tiller is “very pleased” that the court and Six “continue their careful protection of patients’ constitutional rights to privacy no matter how unpopular that may be, to a very vocal minority.”

  At the same time, a witness has reported suspicious activity at Tiller’s late-term abortion mill. A large Penske box truck arrived at Women’s Health Care Services on Monday, February 18, 2008, and was loaded with several boxes that appeared to contain documents, according to eye-witness Margaret Weaver, who was monitoring the late-term abortion mill. The clinic was not open to patients at the time, and no other vehicles came in or out of the parking lot.

  What made the incident more suspicious, reported Weaver, was that the truck’s license plate had been removed. 

“Trucks of this nature are often leased to businesses,” said Operation Rescue President Troy Newman. “But driving a motor vehicle without a license plate is illegal. No legitimate business would operate like that. Something is obviously going on there.

“Something must be done to preserve the integrity of those records until the court rules,” said Newman. “We already know that Planned Parenthood falsified records submitted to a judge in another Kansas abortion investigation. We also documented shredding trucks at Tiller’s destroying documents just days before a Supreme Court ruling on a different records request. Tiller cannot be trusted. From past performance, it is obvious that he will stop at nothing to avoid having to hand over accurate abortion records that could land him in prison, and that includes altering, moving or destroying incriminating evidence.”
