The Schiavo case has shown, as plainly as ever, and to the largest media audience ever, that the U.S. courts are prepared to ignore the most precise legislative instructions from their elected masters, delivered in live time. They will impudently & instinctively insist on turning each critical case on technicalities, and in their judgements, they will insert the most gratuitous expressions of their own personal opinions into the spaces between.
But here is what is interesting. They have now directly defied not merely laws, but the Florida legislature and governor, the U.S. Congress and President. They have waved the red flag. Congress must itself take note of the fact.
The Republicans who control Presidency and Congress will not and cannot now back off. The core of that Republican constituency would not dream of letting them. So it is now, directly, People v. Courts.
This means we’re going to have a constitutional crisis in the U.S. It will play out one way or another. And Canada, which follows behind the U.S. in a strange, perverse, but inevitable way, will watch the upshot of that crisis wash across our border. The same issue must eventually surface here.
