VANCOUVER, May 14, 2001 (LSN.ca) – Mary Wagner, the 26-year-old pro-lifer in BC who has served time in prison for praying within an abortuary bubble zone, was convicted of breach of probation in court Friday and sentenced to 18 months probation. Miss Wagner was charged following a confusing series of events which began when she was sentenced on October 16 for a previous ‘violation’ of the ‘access to abortion’ bubble-zone law. Miss Wagner maintains that on that occasion she was released without having been given a copy of her probationary conditions, but recalls having been instructed by Justice Craig to “keep the peace, and be of good behaviour”.

While the crown suggested that Miss Wagner had knowingly broken her conditions and was deliberately misleading the court, Justice Kitchen found that not to be the case, and opted for a lighter sentence than the 4-6 months jail time sought by the crown. Justice Kitchen appeared visibly moved by a letter written by the accused’s mother, Jane Wagner, testifying to her good character. At this time, there is no word as to whether an appeal is being considered.
