SAN FRANCISCO, December 6, 2002 (LifeSiteNews.com) – Yahoo news reported today that the 9th U.S. Circuit Court of Appeals has upheld an immigration ruling denying asylum to Chinese nationals Xu Ming Li and Xin Kui who insist they fled China to escape forced sterilization and abortion threats .

The young couple’s attorney, Michael Karr, said he would advise them to ask the full court to review the decision by the three-judge panel   The unmarried couple, escaped China in 1998 after officials gave then 19 year old Li a forced pregnancy exam. Court records indicate she was held down while a doctor examined her.

Li stated she was told she would be subjected to more such tests and that any pregnancy would be aborted. Her boyfriend could also be sterilized, she was told   The couple applied for a marriage certificate after the exam, but were told they did not meet the minimum marriage age requirements. They later heard that there was an order for their arrest which caused them to flee to the U.S.  Appeals Court Judge J. Clifford Wallace wrote, “While one may condemn the way Xu was treated as inconsistent with human rights, we cannot say that the record compels us to conclude that her treatment was an ‘extreme form of cruel and inhuman treatment,’ or that she would likely face such treatment on her return.”

Yahoo reports that Judge Richard Paez disagreed. He stated Li qualified for asylum because she was persecuted.
