The latest emergency came as the facility's abortionist and the facility's owner are fighting to keep another unlicensed abortion office open in neighboring Alabama.
Attorney General J. B. Van Hollen said in a court filing that “hospitals accepting federal funds may not discriminate against a physician because that physician has participated in or refused to participate in abortions.”
The case is the most comprehensive case pending, challenging (1) the employer mandate; (2) the abortion mandate for religious employers; (3) the abortion mandate for individuals; and (4) the entire law because tax bills must originate in the House.
