ROME, November 15, 2013 (LifeSiteNews.com) – In a decision that is already being called “ideologically motivated,” a juvenile court in the Italian city of Bologna has allowed a three-year-old child to be fostered by two middle-aged homosexuals.

The court, presided over by Giuseppe Spadaro, ruled that the two men fulfill all the requirements of the adoption law. They have jobs and a good income and are a “stable and reliable couple,” according to a report by Bolongese social workers, fulfilling all conditions for the child’s “serenity and well-being.”

Under Italian law, formal adoption requires that the couple be married, with marriage still defined as being between one man and one woman. But temporary foster parenting has looser restrictions.

Although preference is still supposed to be given to traditional families who already have children in the home, a child can also be given into a “family-style community” made up of any two adults or even a single person. The law does not mention homosexual partners, and in January the Supreme Court ruled that single homosexuals can foster.

Ugo Pastore, chief prosecutor for Bologna, has appealed the decision, saying that the court failed to take into consideration the need for other children to be in the home. He told the website Tempi.it that it is a matter of “indifference” for purposes of the appeal that the couple are homosexuals. The law, he said, “requires that priority be given to couples with children.”

Senator Carlo Giovanardi (PdL) called the decision a result of “contempt for the rights of the child.”

“Italian law permits adoption only to married couples,” Giovanardi said. “No legislator could imagine that the inventiveness of the courts might get to the point of suggesting that a minor can be entrusted to a gay couple.”

Giovanardi added that in law, a couple can only be “composed of a man and a woman.”

Ignazio La Russa, Chairman of the “center-right” group Fratelli d'Italia, said that the courts needed “to think about kids, not ideologies.”

“I’m sure the gay couple who had a child in foster care will try to give [the child] maximum comfort and affection and I understand their desire. But the question is, is it right to deny a child the natural right to be raised by a father and a mother?” he asked.

Franco Grillini, the head of the group Gaynet, issued a statement saying that the court’s decision establishes one of the leading principles of the homosexual movement, “that a gay couple was a family like any other”..

Grillini added that the decision in Bologna “wouldn’t even have been noticed in other countries, because it is considered totally normal.”

He reminded that, having adopted the EU directive on singles, Italy is currently under legal proceedings by the European Union for not applying adoption rules “evenly.”
