EDMONTON, March 4, 2003 (LifeSiteNews.com) – Christine Holowaychuk is suing her ob-gyn Dr. Daniel Hodges and Capital Health for the “wrongful life” of her disabled daughter claiming she would have killed the child by abortion had she known of a chromosomal abnormality. Justice Eric Macklin rejected a delay in the case to determine whether such a claim exists in Canadian law, saying that proceeding would determine a “neat question of law”.
Strangely, the case is being pursued in the name of the child who is thus suing the doctor for not being killed before birth. Jordan Kyra Holowaychuk, was born with serious physical and mental disabilities and the lawsuit seeks damages for the cost of care and pain, suffering and loss of enjoyment of life.
The case, being heard at the Court of Queen’s Bench of Alberta, is expected to last 20 days.
